The American Cancer Society, Inc. (“ACS” or “We” or “Us”) values your trust, and we understand the importance of protecting your privacy. We want to make sure that you understand how your information is collected and used by ACS in the context of our ACS Leadership in Oncology Navigation (LION) Program (“Program”). This Privacy Notice describes the types of information we may collect from you when you visit this website (our "Website"), when you participate in our Program, or when you or third parties communicate with Us regarding the Program. The Notice outlines our practices for collecting, using, maintaining, protecting, and disclosing that information. Please read this Notice carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Website or enroll in the Program. By accessing or using this Website and/or enrolling in the Program, you agree to the terms of this Notice. This Notice may change sometimes. Your continued use of this Website or Program platform after we make changes is deemed acceptance, so please check the Notice periodically for updates.

 

Applicability

This Notice applies to the information we collect:

  • On this Website.
  • In email, text, and other electronic messages between you and this Website and/or Program.
  • Through mobile and desktop applications you download from this Website, which provides dedicated non-browser-based interaction between you and this Website, to the extent available.
  • When you interact with our advertising and applications on third-party websites and services if those applications or advertising include links to this Notice.
  • When you contact the Program via postal mail, telephone, SMS, and/or general email.
  • From third parties, such as in the instance your employer registers for you.

Children Under the Age of 18

Neither our Website nor our Program is intended for children under 18 years of age. We do not sell products or services intended for purchase by children and do not knowingly collect or store any personal information, even in aggregate, about children under the age of 18. If you are under 18, do not use or provide any information on this Website or through any of its features, register on the Website, enroll in the Program, make any purchases through the Website, use any of the interactive features of this Website, or provide any information about yourself to Us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 18, please contact Us at acslion@cancer.org.

Information We Collect About You and How We Collect It

We collect information that identifies you as an individual or information which is linked or linkable to you as an individual, collectively referred to throughout this Privacy Notice as “Personal Information.” The specific categories may include contact information, information to verify identity during assessments, demographic information, health information, financial information, social media information, employment information, and internet (web) activity information including information from cookies (collectively, “Personal Information.” These categories are explained further below. We collect information from and about users of our Website and Program registrants, including:

  • Contact Information and Preferences. We may request contact information such as your login and profile information, name, mailing address, telephone number, e-mail address, and your preferences for how you would like to be contacted by ACS.
  • Identity Verification Information. We use a third-party proctoring service, Meazure, to verify your identity prior to and during the term of the summative assessment. When taking a summative assessment, you will be asked to provide: your username and password, access to your device's camera and microphone, and screen access through a LogMeIn File. You will be required to share your photo ID on camera so that our proctors can verify your identity. The photo ID is deleted within seven (7) days following the close of the proctored assessment session. We may collect recordings of your test session for identity verification, exam integrity, and training purposes. We may also collect information related to test or course names, dates, results, proctors, status, and duration and other time-based metadata (including the amount of time spent answering each question), name, state, and city, proctor assessments, and certificate number and status.
  • Demographic Information. We may request demographic information such as your age, gender identity, race or ethnicity, sexual orientation, geographic location, and education. You are not required to provide this information to enroll in the Program. The information, however, is used to ensure that our testing questions are not biased. We also use demographic information to help us understand the populations we serve.
  • Health Information. If you apply for an accommodation under the Americans with Disabilities Act, we may request health information to verify and/or document the need for the accommodation. This health information may be transmitted electronically for the uses and/or disclosures described in this Notice.
  • Financial Information. If you register for the Program, we may collect payment information such as your credit card number to process your transaction. We may also collect the name of your employer if your registration is being paid for by your employer. We use a third-party payment service to process payments made through the Website. We will retain your credit card information only for as long as necessary to process the transaction.
  • Social Media Information. We may collect social media identifiers and/or interests or opinions expressed if you engage with us directly on social media platforms and/or if you link your certificate/badge to social media sites using the functionality of this Website. Your interactions with social media companies and the use of their features are governed by their privacy policies.
  • Employment Information. We may collect employment information including job titles and organization with whom you work. We use this information to better understand the number and type of health systems engaged.
  • Internet Activity. We may collect web server traffic activity and browsing history which may be tied to your Internet Protocol address or device type. We use this information to measure engagement on the Sites. You can read more about the Internet Activity data we collect below in the Internet Activity section below.
  • Other Sources. We may receive your Personal Information from other sources, such as your employer, if your employer enrolls you in the Program.

How We May Use Your Personal Information

In addition to the uses outlined above by category, We and our service providers may use Personal Information for the following purposes:

  • To present our Website and its contents to you, including the Program if you register.
  • To provide you with information, products, or services that you request from us, including access to course modules and to facilitation of course assessments.
  • To fulfill any other purpose for which you provide it.
  • To provide you with notices about your account and/or your certificate including expiration and renewal notices.
  • To carry out our obligations and enforce our rights arising from any contracts entered between you and us, including for billing and collection.
  • To notify you about changes to our Website or any products or services we offer or provide through it.
  • To allow you to participate in interactive features on our website and in the Program.
  • To contact site visitors and registrants requesting further information or technical support.
  • To conduct analytics and evaluate engagement levels.
  • For any other purpose was you expressly authorize us to do.

 

With Whom We May Disclose/Share Your Personal Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. We may disclose Personal Information we collect, or that you provide, as described in this privacy notice to:

Third-Party Service Providers. We may need to share Personal Information with third parties that provide operational services on our behalf (such as website hosting, information technology and infrastructure, data analytics, email delivery, order fulfillment, auditing, or other services) or that assist Us in providing you with support and resources. Personal Information is only shared with these third-parties pursuant to confidentiality requirements.

Affiliates or Program Transfer. We may provide your information to affiliated organizations that share a common mission with Us and/or to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Us about our Website users is among the assets transferred. 

Third Parties Verifying Certificate Status. We may also share limited Personal Information with third parties who request verification of your Certificate status for employment or reimbursement purposes.

Social Media. If you engage with Us on a public, social media platform, you may be sharing your Personal Information with your friends associated with your social media account, to other website users, and to your social media account provider, in connection with your social sharing activity. By connecting your social media account to your Program account, you authorize us to share information with your social media account provider, and you understand that the use of the information we share will be governed by the social media provider’s privacy policy.

Fulfillment of Services and other Disclosed Purposes. We may share your Personal Information with third parties to fulfill the purpose for which you provide it and for purposes disclosed by Us at the time you provided the information.

Other Uses or Disclosures of Personal Information. We may also use and disclose your Personal Information as we believe to be necessary or appropriate: (a) to comply with applicable law, to respond to requests from public and government authorities, to cooperate with law enforcement, or for other legal reasons; (b) to enforce our Terms of Use and Terms of Sale and other agreements, including for billing and collection purposes; and (c) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others, including exchange of information with other companies and organizations for the purposes of fraud protection and credit risk reduction. In addition, ACS may use, disclose, or transfer your information to a third-party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our organization (including in connection with any bankruptcy or similar proceedings).

Your Consent. In addition to the other disclosures described in this section, we may also disclose your information as you expressly authorize us to do so.

Internet Activity Information

ACS may also collect information that does not reveal your specific identity or does not relate to an identifiable individual, referred to through this Notice as “Internet Activity Information,” including browser and device information, usage data, Internet Protocol address, and information collected through cookies, pixel tags and other technologies.

The technologies we use for this automatic internet activity information collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our Website.
  • Web Beacons. Pages of our Website and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email we sent to them and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

We do not collect personal information automatically, but we may tie this information to personal information about you that we collect from other sources, or you provide to us.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent.   • Promotional Offers from the Company. We may use your contact information to provide you with information on our own products or services. Accessing and Correcting Your Information

You can review and change your personal information by logging into the Website and visiting your account profile page.

You may also send Us an email at acslion@cancer.org to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information, if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

We will comply with all applicable federal, state, and local laws regarding the privacy and security of user information. Your Privacy Rights and Choices

In certain jurisdictions you have specific rights regarding your Personal Information. This section describes your rights and explains how to exercise those rights. Subject to certain limitations (such as our legal obligations), you have the right to access, to obtain a copy of, to correct, to opt-out of the sale or sharing, and to delete your Personal Information.

Some states, such Colorado, Connecticut, and Virginia provide residents of their state with certain privacy rights including the right to:

  • Confirm whether We process their personal information.
  • Access and delete certain personal information.
  • Data portability.
  • Opt-out of personal data processing for targeted advertising and sales.
  • Correct inaccuracies in their personal information, considering its processing purpose.
  • Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.

Right to Appeal. Although We make good faith efforts to comply with privacy rights requests, there may be circumstances in which we are unable to provide access, including but not limited to, where the information would compromise others’ privacy or other legitimate rights, where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy in the case in question, or where the information is subject to legal privilege. Similarly, we may be able to delete Personal Information if we are required by law to maintain it.

If you exercise one of your privacy rights and we are unable to process your request, we will try to explain why the request was denied. The explanation will include information on how to appeal, including the relevant regulatory authorities, based on your state or country of residence. All requests for appeal will be reviewed by the privacy office (acs.dpo@cancer.org).

For California Residents. California Civil Code Section 1798.83 permits California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes during the preceding calendar year. In addition, if you are a California resident under the age of eighteen and a registered user of the Services, you may ask us to remove content or information that you have posted to the Sites. Communication Preferences and Restrictions. We recognize that you may wish to control or limit the ways in which we contact you and/or share your Personal Information. An “Unsubscribe” button will be provided at the top or bottom of each email marketing communication sent by Us, so that you may opt out of further email communications. However, we will continue to send transaction-related emails regarding our relationship and the services you have requested.

 

Changes to Our Privacy Notice

We reserve the right to modify our Privacy Notice at any time. If we make material changes to how we treat our users' personal information, we will notify you by email and/or through a notice on the Website home page. The date the privacy notice was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Website and this privacy notice to check for any changes.
